Legal experts note that while the two terms are often used interchangeably in everyday conversation, they carry significantly different meanings in practice—and can determine whether a matter gets a second chance in court.
When a case is struck out, the court does not evaluate the substance of the dispute. Instead, the matter is removed from the court record due to procedural or technical shortcomings such as filing errors, lack of jurisdiction, or failure to comply with court rules. In such instances, the claimant is typically allowed to rectify the mistakes and refile the case, keeping their pursuit of justice alive.
On the other hand, a dismissal signals a more conclusive outcome. Here, the court examines the merits of the case and determines that the claim lacks sufficient evidence or legal grounding. Once dismissed, the case is effectively closed, and the claimant is generally barred from bringing the same claim again—except under limited circumstances like an appeal.
Legal practitioners emphasize that this distinction is not merely academic but has real implications for litigants. A struck-out case offers an opportunity to “come back properly,” while a dismissed case essentially means the matter has been settled in the eyes of the law.
