The high Court Nullifies ANC–UDA Merger, Declares It Unlawful and Unconstitutional

A court has nullified the merger between the Amani National Congress (ANC) and the United Democratic Alliance (UDA), ruling that the process was unlawful and unconstitutional. In a landmark decision, the court affirmed that ANC remains a duly registered political party under Kenyan law.
The judgment further ordered that all assets and properties transferred to UDA as part of the disputed merger be returned to ANC with immediate effect. The court held that the merger failed to meet mandatory legal and constitutional thresholds governing political party amalgamations.
In its ruling, the court emphasized the need for strict adherence to the Constitution, the Political Parties Act, and internal party procedures, noting that any deviation undermines democratic principles and the rights of party members.
The decision is expected to have far-reaching political implications, particularly within the Kenya Kwanza coalition, where the merger had been considered a key consolidation move ahead of future political contests.
Political observers say the ruling reshapes the political landscape and could trigger fresh realignments as ANC resumes operations as an independent political party. Further directions on compliance and timelines for the return of assets are expected to be issued.
