The walking Constitutional hegemony who is also the Kitui Governor Dr. Julius Makau Malombe has made it clear that the rule of law is more important than following emotional espionage.
The Governor who was part of those who drafted the county acts in 2010 as said he will not break the law he contributed to putting in place.
The three CECMs out of 9 approved CECs are women … That is a third… Which beats a constitutional technicality should the case arise.
As the Governor awaits the county assembly of kitui to convene, I think he can’t swear in the nine Nominees.
The county cabinet is constituted by the Governor, Deputy Governor, & County Executive Committee Members, and so 9+2=11, hence 3/11 doesn’t meet the 2/3rd rule.
The push for Governor Malombe to appoint the 9 approved CECMs is a trap, quagmire, and ploy by the evil schemers who would immediately rush to court arguing that the Governor’s cabinet is unconstitutional.
“Because it would be formed by eight men i.e. GVN+Dep.GVN+6 men CECMs=8 men & 3 women CECMs making it 3/11 which doesn’t meet the 2/3 gender threshold rule” the TCD digital reports.
This is why the remaining nominee has to be approved, as articulated in the memoranda already with the county assembly.
The County Assembly of Kitui should be honest enough to move with speed and exhaust the governor’s Memorandum, either way, to allow the Governor to move to the next level.
As things stand out today the Governor cannot swear in the 9 approved CECM Nominees because there is an active memorandum at the county assembly.
Any legal puritans will agree that the assembly of kitui needs to move with speed to exhaust Governor Malombe’s Memorandum for kitui to move on.
