Court Reinstates 11 Suspended Kitui MCAs Pending Case Determination

The High Court has issued conservatory orders temporarily lifting the suspension of eleven Members of the County Assembly (MCAs) who had been barred from participating in the Assembly’s business for 90 days over alleged misconduct.

The ruling was formally communicated to the House by Speaker Hon. Kevin Kinengo Katisya during Wednesday’s afternoon plenary sitting. The suspended members — Hon. Munyoki Mwinzi, Hon. Jacinta Mwoni, Hon. Daniel Ngoima, Hon. Cyrus Kisavi, Hon. Mercy Muema, Hon. Mary Ndumbu, Hon. Erastus Mbuno, Hon. Sylvester Munyalo, Hon. Mathew Ngovi, Hon. Mary Mutune, and Hon. Hussein Mwandia — had been sanctioned on October 1, 2025, for alleged disorderly conduct in previous sessions.

The MCAs, through their legal representatives, petitioned the High Court seeking several interim conservatory orders, including the suspension of the Speaker’s communication Nos. 050, 051, and 052, which enforced the 90-day suspension. They also sought to restrain the Speaker from excluding certain members from the County Assembly Service Board and from applying specific standing orders related to disciplinary actions.

Upon review, the court granted interim conservatory orders in favor of the petitioners, effectively reinstating them to their legislative duties pending the full hearing and determination of the matter.

In his address, Speaker Kinengo acknowledged receipt of the court order and noted that it raises fundamental constitutional and institutional questions, including the principle of separation of powers, the Assembly’s internal privileges, and the Speaker’s authority to enforce discipline.

He, however, reaffirmed the Assembly’s unwavering commitment to upholding the Constitution, respecting the rule of law, and safeguarding the integrity of the County Assembly of Kitui.
